1.1 The Caritas Association of the Diocese of Graz-Seckau (Caritas) offers those seeking advice free of charge and completely anonymously the opportunity to access the experience and expertise of Caritas employees. The pool of experts covers the entire range of services offered by Caritas Graz-Seckau; counselling takes place online in a technically completely anonymous environment.
1.2 It should be noted that important legal, medical, psychological, economic and other serious situations always require personal, more in-depth counselling, for which the anonymous online counselling of Caritas is no substitute.
2. Registration, user account and use of the services
2.1 The use of the services is only possible with prior registration on the platform, whereby no personal data is to be disclosed. Each registered user receives his/her own user account for an unlimited period of time. A user may only register with one account, multiple registrations are not permitted. An exception is the instant chat, which can be used without registration.
2.2 In the course of registering on the platform, an individual, freely selectable user name (fantasy name, pseudonym, etc.) and a freely selectable password must be entered. If webmail counselling is used, users must provide a valid email address, in particular for the purpose of all correspondence between them and the staff, and agree to receive legally relevant messages to this email address. User names and passwords are to be treated as strictly confidential and may not be made accessible to third parties. If users suspect that their password has become known to a third party, Caritas must be informed immediately so that the account can be blocked or the password changed. In the event of misuse, users are liable according to the care they have taken. The use of online counselling is anonymous. The information provided to Caritas cannot be attributed to any person.
2.3 Certain actions may be harmful to other persons and may also have legal consequences for you. For this reason, for your own protection and the protection of our employees, it is not permitted to carry out such actions on our platform. In the event of harassment, insult and other improper behaviour towards our employees, this behaviour will result in immediate termination of the services, deletion of your data and, if relevant, legal action.
3. Liability
3.1 The scope of the services offered in each case corresponds to the availability of the employees. The services offered by Caritas are voluntary and free of charge. The duration, scope and intensity of online counselling may vary depending on staff capacity, or may be suspended altogether.
3.2 Caritas shall be liable for itself or its vicarious agents only for damage caused by gross negligence or intent; in this case, liability shall be governed by the applicable statutory provisions. Liability for damages due to slight negligence, as well as for consequential damages, lost profits, loss of data or other indirect or incidental damages is excluded.
4 Technical requirements
4.1 For the use of the Services, Internet access as well as an appropriate, up-to-date terminal device including browser are required, which have the technical capacities for the graphic representation of the platform. When using the Services, a considerable volume of data is generated, which can cause costs, especially in the case of mobile use. The costs and risk of internet data traffic lie exclusively with the users.
4.2 Users are aware that due to the technical nature of the Internet, complete protection against viruses, Trojans, spyware, etc. can never be guaranteed. Caritas can therefore not guarantee this protection. Caritas does not guarantee a certain availability of the services and expressly reserves the right to interrupt them for technical or other reasons.
4.3 Caritas cannot guarantee that access to the platform will be possible at all times without interruption and free of errors. Caritas shall not be liable for disruptions or impairments beyond its control.
5. making use of funding and other services provided by Caritas.
5.1 Caritas online counselling is a service that provides low-threshold access to counselling services in an anonymous form. If it becomes apparent during the online counselling that the user is eligible for financial support or can make use of another Caritas service, the user will be made aware of this and referred to the relevant Caritas facility. In this context, no data is collected and transmitted to institutions. The user has to contact the respective institution him/herself.
5.2 Subsidies such as (monetary) services provided by the Counselling Centre to secure livelihoods must be documented and proven to the funding bodies. Therefore, Caritas cannot provide funding or other benefits in an anonymous form. If the user of the online counselling service decides to make use of monetary support from the Counselling Centre for Securing Existence, all absolutely necessary data for the purpose of granting the support/benefit to Caritas must be disclosed. The legal basis for this then results either from the law, the underlying contract or the legitimate interest of Caritas. The duty to inform according to Art. 13 DSGVO will then be carried out separately.
6. Data protection
The provision of personal data is not required and counselling can be provided anonymously and under a pseudonym. Some functionalities, such as the information about the existence of an answer within the framework of the mail consultation or a reminder for an agreed appointment, require the provision of personal data. Any personal data disclosed will be treated confidentially and in compliance with the provisions of the DSG and the DSGVO.
